The 21st Century Cures Act was signed into law on December 13, 2016.
This law, specifically Section 12006(a) of the Century Cures Act, requires each state to implement EVV, or Electronic Visit Verification, for both Medicaid personal care services and home health care services that require an in-home visit by a provider.
While all states have applied for exemptions and been granted a delay, the federal mandate will take effect for just about all home health care services by January 1, 2023.
What Exactly Is Electronic Visit Verification (EVV)?
EVV is essentially where a system captures time in, time out, and the geographic stamp for home health care visits.
Basically, EVV tells the payer that this person clocked in at this time, at this place, and clocked out at this time, at this place. Companies must match this data up with their billing, and if there’s a mismatch, they have to explain why with a reason code.
Will EVV ever really be mandated? Yes. It’s only a matter of time.
Even with the 2023 delay, many providers are holding out hope that it just won’t happen, or it’ll just keep getting pushed off. Or maybe their particular program will fall outside the mandated services.

Even if you’re a wishful thinker, you must understand the risks involved in burying your head in the sand. Simply put: If you don’t have a plan, all of your payments are at risk. The state can say that without EVV data they are not going to pay the claim. So ultimately, you’re putting your whole business at risk on the hope that it just doesn’t come around.
