Texas EVV Compliance Grace Period Ends Soon: How to Stay Compliant

Texas EVV compliance grace period ends soon. Learn key steps to meet the 80% rate and how Cubhub’s EMR can streamline visits and ensure compliance.

As the end of the year approaches, so does the end of Texas’s EVV compliance grace period. Beginning January 1, 2025, all Texas providers must maintain an 80% compliance rate for EVV. This means staying on top of compliance requirements and ensuring each EVV transaction meets state guidelines. Here’s what you need to know to stay compliant and prepared for the new year:

Key Compliance Requirements

To maintain compliance, providers must keep an 80% compliance rate, which is calculated based on two factors:

  1. Rejection Rate: Transactions submitted to TMHP that are initially rejected contribute to non-compliance, even if eventually synced.
  2. Manual Times/Reason Codes: Transactions submitted to TMHP with manual times/reason codes will also affect the compliance score.

If the combined total of these factors exceeds 20%, the provider is considered non-compliant. This rate will be tracked by HHSC, with each MCO having the authority to penalize providers falling below the threshold.

How to Ensure EVV Compliance in 2025

To help you meet Texas EVV compliance requirements in the coming year, here are some key steps to keep your operations on track:

  1. Maintain Up-to-Date Client Information: Ensure that patient payer details, plan codes, and bill codes are always current to prevent avoidable errors and transaction rejections.
  2. Address Errors Immediately: When errors occur, act promptly to resolve them, reducing the risk of repeat issues and keeping future transactions error-free.
  3. Utilize EVV Auto-Rule Applications: Run EVV Detail Reports regularly to identify specific compliance issues, such as missed clock-ins or geo-location errors. These reports make it easy to hold clinicians accountable for any errors affecting compliance.
  4. Monitor Compliance Weekly: Use the EVV Usage Reports available in the TMHP portal to track your compliance status in real-time. Reviewing these reports weekly allows you to address any concerns promptly and stay within compliance guidelines.
